By creating an account or using TriageHealth, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree, you must not use the Service.

1. Definitions and Interpretation

In these Terms and Conditions (“Terms”), the following definitions apply:

  • “TriageHealth”, “we”, “us”, or “our” means TriageMethod Ltd, a company registered in Ireland (trading as TriageHealth, as “TriageHealth”), whose registered office address is available on request.
  • “Service” means the TriageHealth platform, including the website at triagehealth.com, all associated web applications, APIs, reports, AI features, and any related services provided by us.
  • “User”, “you”, or “your” means any individual who accesses or uses the Service, whether as a registered account holder or otherwise.
  • “Account” means a registered user account on the Service.
  • “Report” means any health assessment report, analysis, or output generated by the Service.
  • “Professional Account” means a B2B account designated for licensed healthcare practitioners.
  • “Consumer Account” means any non-Professional account, including Single Report, Bundle, and Annual Pass plans.
  • “Credit” means a unit of entitlement to generate one Report or use a specified AI feature within the Service.

2. Service Description and Medical Disclaimer

2.1 What We Provide

TriageHealth is a health data analytics platform that processes user-provided health information — including blood work results, dietary intake, exercise habits, sleep patterns, stress levels, body composition, medications, supplements, and genetic data — to generate personalised educational health reports with evidence-based insights.

2.2 What We Are Not

  • TriageHealth is NOT a medical device and is not regulated as such under the UK Medical Devices Regulations 2002 (as amended), the EU Medical Devices Regulation (EU) 2017/745, or any equivalent legislation.
  • The Service does NOT provide medical advice, diagnosis, or treatment of any kind.
  • The Service is intended for educational and informational purposes only and must not be used as a substitute for professional medical advice, diagnosis, or treatment.
  • You MUST consult a qualified healthcare professional before making any health-related decisions, including but not limited to changes to medication, diet, supplementation, or exercise.
  • We do NOT replace clinical judgement. Our analysis is based on published research and validated algorithms but has inherent limitations and may not account for your individual clinical circumstances.
  • We accept NO liability for any health outcomes, adverse events, or consequences arising from decisions made on the basis of information provided by the Service.

By using the Service, you expressly acknowledge and agree that any reliance you place on the information provided by TriageHealth is strictly at your own risk. The Service is not a substitute for the skill, judgement, and experience of a qualified healthcare professional.

3. Account Terms

3.1 Eligibility

You must be at least 18 years old to create an Account. Users aged 16 or 17 may create an Account with verifiable parental or guardian consent, in accordance with the UK Age of Digital Consent. We reserve the right to request proof of age or parental consent at any time and to terminate Accounts where eligibility cannot be verified.

3.2 Account Registration

  • You must provide accurate, complete, and current information during registration and keep this information up to date.
  • Each Account is personal and non-transferable. You may not assign, transfer, or licence your Account to any other person.
  • Each individual may hold only one Account. Creating multiple Accounts to circumvent usage limits, pricing, or these Terms is a material breach.
  • We reserve the right to verify your identity and may request supporting documentation.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. You must notify us immediately at info@triagemethod.com if you become aware of any unauthorised use of your Account. We are not liable for any loss or damage arising from your failure to protect your Account credentials.

4. Single User Licence and Anti-Abuse Provisions

THIS CLAUSE IS A MATERIAL TERM OF YOUR AGREEMENT WITH US. BREACH OF THIS CLAUSE MAY RESULT IN IMMEDIATE ACCOUNT TERMINATION AND FINANCIAL PENALTIES.

4.1 Personal Use Only

Each Consumer Account (including Single Report, Bundle, and Annual Pass plans) is licensed exclusively for the analysis of one individual's personal health data. The Account holder must be the sole subject of all health data entered into the Service under that Account.

4.2 Prohibited Conduct

Using a Consumer Account to enter health data for, or generate Reports on behalf of, any person other than the Account holder constitutes a material breach of these Terms. Without limitation, the following activities are expressly prohibited under a Consumer Account:

  • Entering blood work results, dietary data, or other health information belonging to another individual.
  • Generating Reports for family members, friends, clients, or any third party.
  • Operating what is in substance a professional or clinical service using a Consumer Account.
  • Changing demographic data (age, sex, height) between Reports to reflect different individuals.

4.3 Monitoring and Detection

We employ automated systems and manual review processes to detect misuse of Consumer Accounts. Detection methods include, but are not limited to:

  • Trend analysis to identify physiologically inconsistent data patterns indicative of multiple individuals using a single Account.
  • Detection of simultaneous or near-simultaneous blood work entries from different laboratories or with incompatible reference ranges.
  • Monitoring for frequent changes to core demographic data fields.
  • Statistical anomaly detection across Report outputs.

4.4 Consequences of Breach

Where we reasonably determine that a Consumer Account has been used in breach of this clause, we may, without prejudice to any other rights or remedies available to us:

  1. Immediately suspend or terminate the Account without notice or refund.
  2. Invoice for revenue recovery: each Report reasonably identified as having been generated for a third party shall be invoiced at the full single-report price (€25) plus an administrative fee of €50 per incident. Such invoices shall be payable within 14 days of issue.
  3. Pursue legal recovery of all losses, costs, and expenses (including reasonable legal fees) arising from or connected with the breach.
  4. Report the matter to relevant regulatory or professional bodies where the misuse relates to unlicensed clinical practice.

4.5 Professional Use

If you wish to use TriageHealth to generate Reports for persons other than yourself — whether in a clinical, coaching, wellness, or any other professional capacity — you must subscribe to a Professional Account. Professional Account terms are set out in Section 9 below.

4.6 Survival

The obligations and remedies set out in this Section 4 survive termination or expiry of these Terms and of your Account.

5. Subscription and Payment Terms

5.1 Pricing

All prices are displayed on our pricing page at the time of purchase and are inclusive of applicable taxes unless stated otherwise. Prices are quoted in Euros (€) unless your region supports an alternative display currency, in which case the Euro equivalent prevails in the event of any discrepancy.

5.2 Payment Processing

All payments are processed securely by Stripe, Inc. We do not store your full payment card details. By making a purchase, you also agree to Stripe's terms of service.

5.3 Subscription Plans (Annual Pass)

  • Subscription plans auto-renew at the end of each billing period unless cancelled before the renewal date.
  • You may cancel your subscription at any time via your Account settings or by contacting info@triagemethod.com.
  • Upon cancellation, you retain access to all paid features until the end of the current billing period. No partial or pro-rata refunds are provided for unused portions of a billing period.
  • We will send you a reminder email at least 7 days before each renewal.

5.4 Credit Purchases (Single Reports and Bundles)

  • Credits purchased for single Reports or Report bundles are non-refundable once any Credit in the purchase has been used to generate a Report.
  • Unused Credits remain valid for as long as your Account is active.
  • Credits are non-transferable between Accounts.

5.5 Price Changes

  • We reserve the right to change our pricing at any time. Any price changes will be notified to existing subscribers by email at least 30 days before taking effect.
  • Price changes do not affect the current billing period of existing subscriptions.
  • Beta pricing guarantee: Users who subscribed during our beta or early-access period are guaranteed their original subscription price for the first 12 months from the date of their initial subscription purchase.

5.6 Failed Payments

If a renewal payment fails, we will attempt to process the payment up to three additional times over a 14-day period. If all attempts fail, your subscription will be downgraded and access to premium features will be suspended. Your data will be retained in accordance with our data retention policy.

6. Data Handling and Privacy

6.1 Legal Basis for Processing

We process your health data as special category personal data under GDPR Article 9(2)(a) on the basis of your explicit consent, which you provide when you create an Account and submit health data to the Service. You may withdraw your consent at any time, though this may affect your ability to use the Service.

6.2 Data Storage and Security

  • All health data is stored in encrypted PostgreSQL databases hosted in the European Union.
  • Data is encrypted at rest and in transit using industry-standard encryption protocols.
  • We implement appropriate technical and organisational security measures in accordance with GDPR Article 32.

6.3 No Sale of Data

We do NOT sell, rent, lease, or trade your personal health data to any third party, under any circumstances.

6.4 Aggregate and Anonymised Data

We may use aggregate, anonymised, and de-identified data for research, product improvement, and statistical purposes. Such data cannot be used to identify you individually. You may opt out of the inclusion of your data in aggregate analytics at any time via your Account settings.

6.5 Data Portability and Deletion

  • You may request an export of all your data at any time in FHIR R4 compatible format or JSON via your Account settings.
  • You may request deletion of all your data and Account at any time. Deletion will be completed within 30 days of your request, except where we are required by law to retain certain records (e.g., payment records for tax purposes).
  • Following Account deletion, a 30-day data export window is provided before permanent erasure.

6.6 Data Retention

  • Active Accounts: data retained for as long as the Account remains active.
  • Deleted Accounts: data permanently erased within 30 days of deletion request.
  • Payment records: retained for 7 years in accordance with UK tax obligations.

6.7 GDPR Compliance

We comply with the EU General Data Protection Regulation (Regulation (EU) 2016/679) and the Irish Data Protection Act 2018 where applicable. Full details of our data processing practices are set out in our Privacy Policy. In the event of any conflict between these Terms and our Privacy Policy regarding data processing, the Privacy Policy shall prevail.

7. AI Features

7.1 Third-Party AI Provider

The Triage AI chat feature and certain analytical capabilities are powered by third-party artificial intelligence technology (currently provided by Anthropic, PBC). We may change our AI provider at any time without notice.

7.2 AI Disclaimer

All AI-generated responses are for educational and informational purposes only and are subject to the same Medical Disclaimer set out in Section 2.2. AI outputs may contain inaccuracies, may be incomplete, and must not be relied upon as medical advice. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

7.3 AI Data Handling

When you use AI features, relevant health context may be transmitted to our AI provider for the purpose of generating responses. We contractually require our AI providers not to use your data for training purposes. AI conversations may be reviewed internally for quality assurance and safety purposes but are not shared with external parties.

7.4 AI Credits

AI interaction credits are non-transferable between Accounts and expire after 12 consecutive months of Account inactivity.

8. Referral Programme

8.1 How It Works

Registered users may earn referral commissions when individuals they refer to TriageHealth (“Referred Users”) create an Account and make a qualifying purchase. A qualifying purchase is any paid transaction excluding refunded orders.

8.2 Commission Terms

  • Commission rate: 10% of the Referred User's qualifying spend, earned for the first 12 months from the Referred User's registration date.
  • Minimum payout threshold: €50. Accrued commissions below this threshold will be carried forward.
  • Commissions are paid via the method specified in your Account settings.

8.3 Prohibited Referral Practices

The following referral practices are prohibited and will result in forfeiture of all accrued commissions and potential Account termination:

  • Self-referrals (referring yourself via an alternative Account or identity).
  • Fraudulent, fake, or manufactured referrals.
  • Spam, unsolicited bulk messaging, or misleading advertising to generate referrals.
  • Any referral activity that violates applicable laws or regulations.

8.4 Changes and Withholding

We reserve the right to modify the commission structure, rates, or programme rules at any time with 30 days' email notice to participants. We may withhold or claw back commissions where we reasonably suspect fraud or abuse.

8.5 Tax Responsibility

Referral commissions may constitute taxable income. You are solely responsible for reporting and paying all taxes due on commissions earned through the referral programme. We may request tax identification information and may be required to report commission payments to tax authorities.

9. Professional (B2B) Account Terms

9.1 Eligibility

Professional Accounts are available to licensed, registered, or otherwise qualified healthcare practitioners, including but not limited to medical doctors, registered dietitians, registered nutritionists, clinical pharmacists, and other professionals operating under a recognised regulatory body.

9.2 Clinical Responsibility

The practitioner is solely responsible for all clinical decisions made in relation to their clients. TriageHealth is a decision-support tool only and does not replace clinical judgement, professional training, or regulatory obligations. The practitioner acknowledges that Reports generated through the Service are supplementary and must be interpreted in the context of the client's full clinical picture.

9.3 Data Processing Relationship

Where a practitioner enters client data into the Service, the practitioner is the data controller and TriageHealth acts as data processor in respect of that client data. The terms of data processing are set out in our Data Processing Agreement. The practitioner warrants that they have obtained all necessary consents from their clients for the processing of health data through the Service.

9.4 Practitioner Consent Obligations

Before entering any client data, the practitioner must have obtained informed, specific, and freely given consent from the client for:

  • The processing of their health data through the TriageHealth platform.
  • The generation and storage of health Reports based on their data.
  • The sharing of relevant data with TriageHealth's sub-processors as described in our Privacy Policy.

9.5 Intellectual Property in Reports

Reports generated through Professional Accounts, including any white-label or branded variants, remain the intellectual property of TriageMethod Ltd. Practitioners are granted a non-exclusive, non-transferable licence to use Reports in the course of their professional practice with the specific clients for whom they were generated.

9.6 API Access and Fair Use

Where API access is provided, it is subject to published rate limits and a fair use policy. We reserve the right to throttle or suspend API access where usage is excessive, abusive, or threatens the stability of the Service.

10. Intellectual Property

10.1 Our Intellectual Property

All algorithms, analysis engines, scoring methodologies, report templates, report designs, educational content, food and biomarker databases, software code, trade marks, and other materials comprising the Service are the intellectual property of TriageMethod Ltd and are protected by copyright, database rights, and other intellectual property laws.

10.2 Your Data

You retain ownership of all health data you submit to the Service. By submitting data, you grant us a limited, non-exclusive, revocable licence to process it solely for the purpose of providing the Service to you.

10.3 Report Usage

  • You may share your own Reports with healthcare professionals, family members, or other parties for your personal health management purposes.
  • You may NOT use Report content for commercial purposes, publication, redistribution, or resale without our prior written consent.

10.4 Restrictions

You may not, and you may not permit any third party to:

  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or methodologies of the Service.
  • Scrape, crawl, or use automated means to extract data or content from the Service without our prior written permission.
  • Copy, reproduce, modify, adapt, or create derivative works based on our analysis methodology, scoring systems, or report formats.
  • Remove, alter, or obscure any proprietary notices, labels, or markings on or in the Service or its outputs.

11. Acceptable Use

In addition to the restrictions elsewhere in these Terms, you agree not to:

  • Use the Service for any unlawful, fraudulent, or malicious purpose.
  • Submit false, fabricated, or deliberately misleading health data with the intent to manipulate outputs or test system vulnerabilities.
  • Use automated systems, bots, or scrapers to access the Service without our prior written authorisation.
  • Attempt to gain unauthorised access to any part of the Service, other user Accounts, or our systems and infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Use the Service to develop a competing product or service.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

12. Limitation of Liability

12.1 Health Outcomes

To the fullest extent permitted by applicable law, we accept no liability whatsoever for any health outcomes, medical decisions, treatment choices, or consequences arising directly or indirectly from your use of the Service or reliance on any information, Report, or AI-generated content provided through the Service.

12.2 Cap on Liability

Subject to Section 12.4, our total aggregate liability to you for all claims arising out of or in connection with the Service and these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount you paid to us in the 12 months immediately preceding the event giving rise to the claim.

12.3 Exclusion of Certain Losses

Subject to Section 12.4, we shall not be liable for any:

  • Indirect, incidental, special, or consequential loss or damage.
  • Loss of profits, revenue, business, anticipated savings, or goodwill.
  • Loss of data (other than as required under our data protection obligations).
  • Punitive or exemplary damages.

This applies whether or not we were advised of the possibility of such loss or damage and regardless of the cause of action.

12.4 Nothing Excluded

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under the laws of Ireland.

12.5 No Warranty of Availability

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, civil unrest, government actions, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.

13. Termination

13.1 Termination by You

You may terminate your Account at any time by using the deletion feature in your Account settings or by contacting info@triagemethod.com. If you have an active subscription, cancellation will take effect at the end of the current billing period.

13.2 Termination by Us

We may terminate or suspend your Account:

  • With immediate effect and without notice if you commit a material breach of these Terms (including, without limitation, breach of Section 4).
  • On 30 days' written notice for any other reason, in which case we will provide a pro-rata refund for any unused prepaid subscription period.

13.3 Suspension Pending Investigation

We may suspend your Account at any time pending investigation of suspected breach, abuse, or fraud. During suspension, you will not be able to access the Service, but your data will be preserved.

13.4 Effect of Termination

  • Upon termination, you will have a 30-day window to export your data before it is permanently deleted.
  • All licences granted to you under these Terms will immediately cease.
  • Termination does not affect any rights or obligations that accrued prior to the date of termination.

13.5 Surviving Provisions

Sections 2.2 (Medical Disclaimer), 4 (Single User Licence and Anti-Abuse), 10 (Intellectual Property), 12 (Limitation of Liability), 13 (Termination), 14 (Dispute Resolution), and 16 (Severability) shall survive the termination or expiry of these Terms.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Ireland.

14.2 Jurisdiction

The courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. Nothing in this clause limits our right to take proceedings in any other court of competent jurisdiction.

14.3 Complaints Procedure

We encourage you to resolve any concerns through our support team before initiating formal proceedings. Our complaints procedure is as follows:

  1. Initial contact: Email info@triagemethod.com with details of your complaint.
  2. Acknowledgement: We will acknowledge your complaint within 3 business days.
  3. Resolution: We aim to resolve complaints within 14 days. If we are unable to do so, we will escalate your complaint internally and provide you with a written response within 28 days.

14.4 Consumer Rights

If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

15. Changes to These Terms

15.1 Right to Amend

We may update or amend these Terms from time to time to reflect changes in our Service, legal requirements, or business practices.

15.2 Notice of Changes

We will notify you of any changes by email to the address associated with your Account at least 30 days before the changes take effect. The updated Terms will also be published on this page with a revised “Last updated” date.

15.3 Acceptance of Changes

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. For material changes that significantly affect your rights or obligations, we will require explicit re-acceptance (for example, by presenting the updated Terms upon login).

15.4 Rejection of Changes

If you do not agree with the revised Terms, you must stop using the Service before the changes take effect and may terminate your Account in accordance with Section 13.1.

16. Severability

If any provision or part-provision of these Terms is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification or deletion of a provision under this Section shall not affect the validity and enforceability of the remaining provisions of these Terms.

17. Cookies

Our use of cookies is governed by our Cookie Policy. In summary:

  • Essential cookies: Always active. Required for the Service to function (e.g., authentication, security).
  • Analytics cookies: Opt-in only. Used to help us understand how the Service is used and to improve it. You may manage your cookie preferences at any time via the cookie settings on our website.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Medical Disclaimer, and Data Processing Agreement (where applicable), constitute the entire agreement between you and us in relation to your use of the Service and supersede all prior agreements and understandings, whether oral or written.

18.2 Waiver

No failure or delay by us to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

18.3 Third-Party Rights

No person other than you and us shall have any rights to enforce any of these Terms. These Terms do not confer any rights on any third party.

18.4 Assignment

You may not assign, transfer, sub-license, or otherwise dispose of any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any third party without your consent, provided that such assignment does not materially diminish your rights under these Terms.

18.5 Notices

Any notice required or permitted under these Terms shall be in writing and shall be deemed given when sent by email to: (a) for notices to us, info@triagemethod.com; and (b) for notices to you, the email address associated with your Account.
